Any page that collects or displays protected health information, or which is used for logging users in, which transmits authorization cookies, etc., must be protected by SSL and must not be accessible insecurely (i.e., there should not be an alternate insecure version of the same page that people can access).

3. Make sure SSL configuration is strong enough to prevent methods of encryption that are “too weak;” Be sure of what level of SSL or TLS is Required by HIPAA for your website.

« Backup: Data related to health should not be lost. It should always have a backup and
should be recovered with ease.

1. Be sure that all PHI stored with your website or collected from your website is backed up and can be recovered in case of an emergency or accidental deletion.

2. Most web hosts provide this service for information stored on their servers. If your site sends information elsewhere (for example, to you via email), then those messages must also be backed up or archived and you must take care that those backups are robust, available, and accessible only by authorized people.

3. Note that the PHI stored in backups must also be protected in a HIPAA-compliant way — with security, authorization controls, etc.

« Omnibus/HITECH: Make sure protected health information located on the web servers of a company with whom you have business association have HIPAA Business Associate Agreement as per HIPAA security rule requirements.

1. Sign a Business Associate Agreement with vendors/businesses. This agreement ensures that the vendor will follow the HIPAA security rule requirements concerning your data and its servers.

2. No web hosting provider will be policing your website functionality and content. Instead, they will be providing an “infrastructure” that meets HIPAA compliance requirements and they will require you to design and manage your website so that its functionality is HIPAA-compliant.

3. Choosing a provider will not make your website HIPAA-compliant unless you and your designers ALSO take all the steps to ensure that its design and functionality is compliant. This is universal unless you buy a website that is pre-designed and fully under the control of the host.

HIPAA Privacy Rule: What Companies operating in healthcare should know?

Health Insurance Portability and Accountability Act of 1996 (HIPAA)

Brief History

Health Insurance Portability and Accountability (HIPAA) act or the Kennedy-Kassebaum Act is a United statute federal law. It was created initially to modernize the flow of information on healthcare and how personal health information is captured and maintained by healthcare and health insurance industries. HIPAA is a national standard to protect patients’ sensitive personal health information from fraud and theft and address healthcare insurance coverage limitations.

HIPAA act was enacted by the 104th Unites States Congress and signed by President Bill Clinton on 21st August 1996. To standardise and protect the patient’s health information from being disclosed without the patient’s content or knowledge, the US Department of Health and Human Services (HHS) issued the HIPAA Privacy Rule to implement HIPAA requirements. 

The HIPAA Security Rule protects a subset of information covered by the HIPAA Privacy Rule.

Health Insurance Portability and Accountability Act (HIPAA)

HIPAA Privacy Rule 

The HIPAA privacy rule contains standards for individuals’ rights to understand and control how their information is used and call it “Protected Health Information” subject to the privacy rule. The entities which follow the privacy rule standards are called “Covered Entities” (Individuals and Organizations)

The privacy rule focus on:

      1. Standards for individuals’ rights to understand and control how their health information is used. 
      2. Ensures that individuals’ health information is properly protected while still allowing the flow of health information as needed to provide and promote high-quality health care.
      3. Protect the public’s health and well-being by striking a balance and permitting important information uses while protecting privacy.
      4.  Safeguards data and prevent it from being accessed by unauthorized individuals. 
      5. HIPAA allows patients to obtain copies of their health information

Need for HIPAA Compliance

According to Health and Human Services (HHS), as the healthcare move to computerized operations, including Electronic Medical Records (EMR),Electronic Health Records (EHR), computerized physician order entry (CPOE) systems, radiology, pharmacy, and laboratory systems, HIPAA compliance is more important for health care providers and other entities dealing with Protected Health Information (PHI) since electronic information increases the security risks though it increases efficiency and mobility. 

The privacy rule protects the technical and nontechnical entities and secure individuals’ electronic PHI(e-PHI). The office Civil Rights (OCR) is responsible for enforcing all the Privacy and Security Rules with voluntary compliance activities and civil money penalties. The security rule establishes a national set of security standards for protecting health information held/transferred in electronic form.

The Security Rule, by design, is flexible enough to allow a covered entity to implement policies, procedures, and technologies that are suited to the entity’s size, organizational structure, and risks to patients’ and consumers’ e-PHI. The Security Rule protect the privacy of individuals’ health information, while at the same time allowing covered entities to adopt new technologies to improve the quality and efficiency of patient care.

Covered Entities

Subject to the Privacy Rule the following types of individuals and organizations are considered covered entities:

    • Healthcare providers: Anyhealthcare provider electronically transmits health information connected with certain transactions regardless of the size of the practice. These transactions include claims, benefit eligibility inquiries, referral authorization requests, and other transactions for which HHS has established standards under the HIPAA Transactions Rule.
    • Health plans Entities that provide or pay the cost of medical care. Health plans include health, dental, vision, and prescription drug insurers; health maintenance organizations (HMOs); Medicare, Medicaid, Medicare+Choice, and Medicare supplement insurers: and long-term care insurers (excluding nursing home fixed-indemnity policies). Health plans also include employer-sponsored group health plans, government- and church-sponsored health plans, and multi-employer health plans.

Exception: A group health plan with fewer than 50 participants that is administered solely by the employer that established and maintains the plan is not a covered entity.

    • Healthcare clearinghouses: Entities that process nonstandard information they receive from another entity into a standard (i.e., standard format or data content), or vice versa. In most cases, healthcare clearinghouses will receive individually identifiable health information only when they are providing these processing services to a health plan or healthcare provider as a business associate.
    • Business associates: A person or organization (other than a member of a covered entity’s workforce) using or disclosing individually identifiable health information to perform or provide functions, activities, or services for a covered entity. These functions, activities, or services include claims processing, data analysis, utilization review, and billing.

By law, the HIPAA Privacy Rule applies only to covered entities — health plans, health care clearinghouses, and certain health care providers. However, most health care providers and health plans do not carry out all their health care activities and functions by themselves. Instead, they often use the services of a variety of other persons or businesses. 

The Privacy Rule allows covered providers and health plans to disclose protected health information to these “business associates” if the providers or plans obtain satisfactory assurances that the business associate will use the information only for the purposes for which it was engaged by the covered entity, will safeguard the information from misuse, and will help the covered entity comply with some of the covered entity’s duties under the Privacy Rule. Covered entities may disclose protected health information to an entity in its role as a business associate only to help the covered entity carry out its health care functions — not for the business associate’s independent use or purposes, except as needed for the proper management and administration of the business associate.

Requirements for HIPAA Compliance

The regulation of HIPAA sets national standards that all covered entities and business associates must address.

    • Self-Audits:
      1. a) Conduct annual audits of their organization to assess Administrative, Technical, and Physical gaps in compliance with HIPAA Privacy and Security standards. 
      2. b) Under HIPAA, a Security Risk Assessment is NOT ENOUGH to be compliant–it’s only one essential audit that HIPAA-beholden entities are required to perform to maintain their compliance year-over-year.
    • Remediation Plans:

Once identified their gaps in compliance through these self-audits, they must implement remediation plans to reverse compliance violations. The remediation plans must be fully documented and include calendar dates by which gaps will be remedied.

    • Policies, Procedures, Employee Training: 
      1. a) Develop Policies and Procedures corresponding to HIPAA regulatory standards as outlined by the HIPAA Rules. These rules should be regularly updated and adapted in the organization.
      2. b) Annual staff training on these Policies and Procedures is required and should document employee attestation stating that staff has read and understood each of the organization’s policies and procedures. 
    • Documentation: 

HIPAA-beholden organizations must document ALL efforts they take to become HIPAA compliant. This documentation is critical during a HIPAA investigation with HHS OCR to pass HIPAA audits.

    • Business Associate Management:
      1. a) Document all the vendor’s details with whomsoever(vendors) associated with covered entities about the PHI shared in any way and execute Business Associate Agreements to ensure PHI is handled securely and mitigate liability. 
      2. b) Conduct an annual review to account for changes to the nature of organizational relationships with vendors and this must be executed before ANY PHI can be shared.
    • Incident Management: 

Should have a process to document the breached data if a covered entity or business associate has made a data breach and notify patients that their data has been compromised according to the HIPAA Breach Notification Rule. 

Effective Compliance Program for Organizations to vet compliance programs

Seven Elements of an Effective Compliance Program has been created by the HHS Office of Inspector General (OIG) to guide organizations to vet compliance solutions or create their own compliance programs.

These are the barebones, absolute minimum requirements that an effective compliance program must address. In addition to these, a full extent of mandated HIPAA Privacy and Security standards, an effective compliance program must have all the capacity to mandate all the seven elements.

The Seven Elements of an Effective Compliance Program are given below:

        1. Implementing written policies, procedures, and standards of conduct.
        2. Designating a compliance officer and compliance committee.
        3. Conducting effective training and education.
        4. Developing effective lines of communication.
        5. Conducting internal monitoring and auditing.
        6. Enforcing standards through well-publicized disciplinary guidelines.
        7. Responding promptly to detected offences and undertaking corrective action.

To judge the effectiveness of HIPAA compliance over the course, a HIPAA investigation will be carried out by Office for Civil Rights (OCR) in response to a HIPAA violation, federal HIPAA auditors will compare your organization’s compliance program against all the Seven Elements listed above.

What is a HIPAA violation?

“A HIPAA violation is any breach in an organization’s compliance program that compromises the integrity of PHI or ePHI.”

A data breach becomes a HIPAA violation when the breach is the result of an ineffective, incomplete, or outdated HIPAA compliance program or a direct violation of an organization’s HIPAA policies.

Not all data breaches are HIPAA violations. A HIPAA violation differs from all other data breaches. Few examples: If the company does not have a policy barring laptop being taken offsite or encrypted when employees have an unencrypted company laptop with access to medical records and just in case if the laptop gets stolen, it is considered to be HIPAA VIOLATION as the company does not have a policy in place.

a) There are a set of protocols under HIPAA regulation that must be followed by covered entities and business associates in the vent of a breach. 

b) If breach affecting fewer than 500 individuals in a single jurisdiction. The HIPAA Breach Notification Rule requires entities to gather data on all smaller breaches that occur over the course of the year and report them to HHS OCR within 60 days of the end of the calendar year in which they occurred.

c) Affected individuals must be notified that their data was involved in a breach within 60 days of the discovery of the breach.

d) Local law enforcement agencies should also be contacted immediately, in addition to local media agencies to alert potentially affected individuals within the necessary jurisdiction.

And all the breaches affecting 500 or more individuals are posted on the HHS Breach Notification Portal, or “Wall of Shame.”

This HHS Wall of Shame is a permanent archive of all HIPPA violations covered since 2009 in the US of large-scale breaches and can be searchable. This searchable database is a concrete consequence of a HIPAA violation that can permanently damage the reputation of healthcare organizations that experience a HIPAA violation or large-scale breach.

In 2017, OCR levied its first HIPAA settlement for a violation of the Breach Notification Rule. The First in the history of HIPPA enforcement, a $475,000 fine against Presence Health was levied for failure to properly follow the HIPAA Breach Notification Rule. Fines range between $100-$50,000 per incident depending on the level of perceived negligence, Federal HIPAA auditors levy HIPAA fines on a sliding scale.

If auditors detect that the organization under investigation has neglected to perform a “good faith effort” toward HIPAA compliance, fines can become astronomical.

Medical data is worth three times as much as financial data on the black market. Hence healthcare organizations are vulnerable to cybersecurity attacks. HIPAA security safeguards can defend health care organizations against ransomware and prevent HIPAA violations.
      • The Minimum Necessary Rule: This is a component of the HIPPA Privacy Rule. It states that employees of covered entities may only access, use, transmit, or otherwise handle the minimum amount of PHI necessary to complete a given task. If a large portion of a patient’s medical record is exposed more than what is necessary, it is considered a data breach and can lead to a violation of the HIPAA Privacy Rule and resultant HIPAA fines.
      • Access controls: Limits the number of staff members at an organization that has access to PHI.
      • Notice of Privacy Practices: It is mandatory to have a notice of Privacy to meet the standards of the HIPAA Privacy Rule. Covered entities must allow patients to review and agree to their organizational Notice of Privacy Practices before beginning treatment. Patients have certain rights to the access, privacy, and integrity of their health care data and PHI.

Who is not required under HIPAA?

Many organizations that have health information about you do not have to follow these laws.

Examples of organizations that do not have to follow the Privacy and Security Rules include:

      • Life insurers

Of course, there are far beyond benefits of exercising regularly. It can improve brain function, improve memory, help in handle stress more effectively, brings you glowing skin and enhances your social life and last of all it will make you relax and breaks the monotony of working from home.

    How to get into our routine?

If you think you have no time for exercising, then you need to understand that people who exercise regularly are the ones who carve out that time for their own benefit. Change your perspective, stop giving your busy life as an excuse not to exercise. If you have no time to go to the gym or buy expensive equipment, take it easy. Do sit-ups, Push-ups, yoga, and many other exercises which will not do any harm to your body and can be done without equipment. Walking or running is even good. So, get back on the mat and start with your workout plan. Please listen to your body and do not push way too hard. Start slow but be consistent.

How to get motivation?

If you dream of a healthy body, you need to start working for it. Rather than just planning put on your workout clothes and start. Exercise is all about improving your health and life. Start with an early morning brisk walk of at least 15 minutes. Walking increases your heart rate and kickstart your metabolism relieving you from stress. Based on your other work commitments during the day make your own schedule and remember housework counts as exercise. If you can convince yourself and take out time for your workout it can boost your energy and make you efficient throughout the day.

You can also consider joining social networking site or any online community with fitness trainers and nutrition experts to get support and encouragement from other people who are trying to be fit and healthy. When you do it together you may feel motivated.

Staying active while working from home may sound like a dream but it is important for both your physical and mental health to remain active. It may take some time and need self-discipline. Being sedentary for long periods can harm your health even after you have done your exercise for the day! Sitting at your desk for long hours can put you at risk for heart disease, obesity, diabetes, and high blood pressure. So, set a timer while you are working that can remind you to move for few minutes every hour. Staying motivated and productive during these uncertain times can be challenging. Facing uncertainty, in a true sense, is a lot more difficult than enduring physical pain. It can disrupt our life and create uncertainty, which can cause fear and anxiety about the present and future.

It is currently very important to stay motivated and productive and we must get rid of stress, open our minds to new ideas, learn, and have different perspectives about life. Here I have listed 7 ways that can help us to stay motivated and productive during these difficult times.

1. Focus on what you have and celebrate every little thing

With so many negative things happening around you it is hard to stay positive. However, try and focus on positives and find innovative ways to continue working, living, dreaming, and hoping for a better future. It is important to focus on what you have and put your energy into the good things in your life no matter how bad you may be feeling. Always keep your mind and thoughts positive. Feeling positive and hopeful for a better future can go a long way in helping us to feel motivated.

2. Stay connected with yourself first and then with friends and family

Pandemic allowed us to spend more time with ourselves. Use this time to know yourself and reflect. Building a relationship with oneself is as important as building it with others. Also, be in touch with your friends and family members to motivate them, lift their spirits, and alleviate their mood, which eventually brings you joy. It can bring a sense of togetherness and strengthen our bonds.

3. Dream: Set a goal for yourself and work for it

If you do not have a dream, you will lose hope in life and you will become less motivated
because you might feel that you have nothing to accomplish, and no goals to achieve and you gradually lose interest in your own self! Learn new traits, take up online courses, cook, dance, sing do what makes you  excited and brings joy to you! Make a routine and fix it, also allow yourself to relax and enjoy.

4. Find yourself and get motivated

Spend enough time with yourself, be honest with yourself, forgive yourself and discover what really motivates you. Let go of things that made you cry, rediscover your happiness and bloom with grace. Do whatever makes you happy and spend your time valuably to explore your own self and bring positivity to your life. There are many reasons to be sad and disappointed, but you find that one reason which can keep you motivated!

5. Accept what it is and accommodate yourself

The situation we all are in is our existing reality! Let us all accept it and find ways to live
with it. Digitization has taken over and it has re-engineered the way we used to live, work,
and connect. We all are dependent on technology to study, work and socialize therefore it is important to embrace technology and sustain with our work and lives.

6. Do not blame yourself: Say no to guilt

It is very normal to feel low and feel guilty about everything that did not go right, take it easy it is ok to feel that way. It is a normal feeling! To overcome this low moment, give more time to yourself! Find your “ME TIME”, take care of yourself. Self-care is very important and honour your body and give your time to groom it. Always make time to relax and do what makes you relax. Watch your favourite movie, have a long bath, listen to music, try cooking, meditate or workout find your way. When you self-indulge, you will not search for happiness outside, you will find it within. Prepare yourself for tomorrow! What went by will never come back so stop worrying about and think about tomorrow. Prioritize your life, do what is necessary and do not stress yourself, do one thing at a time, and be kind to yourself. We all have bad days, we all feel low, and this is completely normal. But what is important is how fast we can come out of it and restart again.

7. Plan your day: Make a daily routine

We are used to the specific routines at home, school and workplace that boost us through the day. Routines keep you motivated and keep us prepared for the next action and next role. Unfortunately, the pandemic has forced us to be at home. It is difficult to work or study from home with all the drama happening around. So, make the routine, particularly on your own work schedule. Try to set tasks for the next day, create a morning routine and for the entire day. Set your goals for the next day and make sure your goals are realistic and have your food on time. Give yourself proper break to rest and work.

Overall, I would like to conclude by saying that life has no rules to live! Live how you want
but make sure you live right! Now, how to live right is the question one should ask self and
find answers to life, to be motivated and happy! Ultimately finding ourselves, listening to
what our mind says and converging our thoughts, efforts on things that make us happy will
bring meaning and ultimate joy to our lives!

Carbon Emissions, a Global Concern!

Why it matters?

The greenhouse gases have kept the Earth’s climate habitable for humans and many millions of other species by trapping heat from the sun. But the greenhouse gases are out of balance and threatens the lives on the planet — Earth.

The levels of carbon dioxide (CO2) in the atmosphere currently are at the highest level, which is caused by fossil fuel burning by humans. Carbon emissions are overwhelming and carbon emission growth has caused the ice caps of the Arctic to melt, resulting in rising sea levels and causing damage to wildlife, destroying their home!

The common gas emitted into the atmosphere includes Methane (CH4) is released from natural gas, landfills, as well as by the petroleum companies, and the agriculture process(especially from the digestive systems of grazing animals), Nitrous oxide (N2O) is released from the agricultural process, livestock and includes fertilizer, manure, and burning of agricultural residues, along with burning fuel, and fluorinated gases, Industrial gases such as hydrofluorocarbons, perfluorocarbons, chlorofluorocarbons, sulphur hexafluoride (SF6), and nitrogen trifluoride (NF3) are released when used as refrigerants, solvents and can also be a by-product. These gases absorb solar energy and keep it trapped in the form of heat close to the Earth’s surface without letting it escape into space, and this process of trapping heat is called the Greenhouse Effect. American climate scientist James E. Hansen was the first one to testify the greenhouse effect and explained how it contributes to our climate change¹.

The greenhouse effect has far-ranging health and environmental issues. It contributes to respiratory disease, extreme weather conditions, disruption in food production/supply, increases wildfires creating a major climate change caused by greenhouse gases. These effects are widely recognised, and the world needs to urgently work towards reducing carbon emissions, a primary driver of global warming and protect our planet¹.

Key highlights from 2020 about carbon emissions

The global greenhouse gas emissions descended by 2.4 billion tons in 2020, which is about a 7% drop from 2019. Interestingly the largest decline is recorded due to worldwide pandemic Covid-19 imposed restrictions.

 Countries like the U.S saw the largest drop in carbon emission of 12%, the European Union recorded an 11% drop followed by India, recorded a 9% drop and China, a drop of 1.7% in CO2 emissions due to decline in transportation activities.

Emission could rebound in 2021, as predicted by researchers and has urged all the related organizations and government sectors to prioritise and implement policies to tackle climate changes.

 

 

 In 2020, the Intergovernmental Panel on Climate Change (IPCC) reported an interesting fact about global warming. Reducing global warming to 1.5°C is required to control unprecedented changes in the environment. It also mentions the net carbon dioxide (CO2) emission from human-caused emissions would also need to fall to net-zero around 2050².

What is a Carbon Footprint?

The total amount of greenhouse gas released into the atmosphere that comes from the Humans, Industries or by a particular activity.

How does an individual contribute to Carbon Footprint?

The bulk of an individual’s carbon footprint will usually come from housing, food, and transportation.

How can we reduce greenhouse gas emissions?

· Reduce the use of fossil fuels: Every sector of the global economy should collectively work towards reducing greenhouse gas emissions. China, the United States, and India are the major contributors to the world’s greenhouse gas emissions. It is crucial to move away from fossil fuels and use renewable sources to boost energy efficiency and reduce carbon emissions to avoid effects on climate changes.

· Conserve trees & forests: To reduce carbon emissions just phasing out fossil fuels will not help, but planting trees, conserving existing plants, trees, forests, and grasslands, reducing CO2 from factories and powerplants are some of the other ways to rely on capturing CO2 from the sky.

· Constantly monitor greenhouse effects & implement solutions: Government sectors and various organizations around the world monitors climate change and measures greenhouse gases to track all the impacts and implement solutions to overcome the greenhouse effects. One such organization is the Intergovernmental Panel on Climate Change (IPCC), the United Nations body that works towards tracking and implementing solutions to reduce greenhouse effects.

There is a need for real solutions to reduce carbon emissions globally. There are choices me, you & we can all together make in day-to-day life to reduce personal contribution in the amount of carbon dioxide released into the atmosphere.

While there are many ways, we can contribute to reducing carbon footprints individually. Here are the few little things we can do and listed below for you.

· Using public transportation, carpooling, driving low carbon emission vehicles with high mileage, and switch to electric vehicles. Avoid unnecessary braking and acceleration. Drive wisely!

· Improve home insulation.

· Switch to LED/compact fluorescent bulbs. Turn off lights/fans/AC, any electronic devices when not in use and when you leave the room. Use a programmable device to turn off the heat/air conditioning.

· Walk, go biking to office, parks and to nearby places. It can be a great workout to keep us healthy and reduces emissions.

· Use natural resources. Install solar panels to the roof of your home. Save electricity save money! And even make money by selling electricity back to the grid. You will get financial assistance from the government for solar panel installation.

· Eat organic food. Change your diet, reduce meat and dairy product intake.

· Reuse and recycle.

· Reduce water usage. It reduces the energy used to pump, treat, and heat.

· Use renewable and clean resource of energy.

· Use reusable bags to avoid plastic.

· Contribute to the projects that work towards reducing greenhouse gases.

· Be responsible and take initiatives to protect our planet Earth.

To conclude, climate change is alarming and solving it is a global challenge. Governments of all the nations and other organization should create well-defined projects, policies and implement it to tackle climate changes due to greenhouse gases. But that is not enough, the individual actions from everybody are crucial to breakdown the climate-related issues and address them bit by bit. We all could make a difference by changing our day-to-day habits. Let us make a sustainability-oriented decision.
